My sister did steal about $80,000, and shared it with my 2 brothers, by convincing moms tenants that she was taking over since her mom was declared incompetent, and I was physically abusing our mother and stealing her income. Since my sister wouldn't stop her stealing, mom files a restraining order against her. However, the Judge refused to look at the overwhelming proof of her stealing, called it a sibling rivalry (not a criminal act of stealing), then threw an attorney at litem, an attorney for my mom, and tied up the restraining order for 1 1/2 years. Finally when restraining order ready to go, my sister retains an attorney for $18,000 (which was paid my our mothers estate later), who throws moms estate into fucking probate, and has a Financial Conservator take over all of my mothers money. This trumped the retaining order request against her for ever, where she was never asked about the money she stole or ever been held accountable. My current problem is the monitoring the Conservator now, who is stealing all of our mothers income, and starting to sell her real estate now. QUESTION: Can I petition to have the estate returned to me as my mothers Successor Trustee, when it is 3 against 1, but their accusations totally without truth or proof, and my claims fully back by unquestionable proof ??Again, this is where my siblings are getting away with a crime committed on their part, but NOT a sibling rivalry where a Conservator would be needed!!! Please advise and thank you for anyone who responds!!! She moved from UT to OR. We sold her home for a modest amount and her savings is also fairly modest. Intuitively I want her to save all of her money for a rainy day. She wants to gift some of it to my two siblings and me. She wants my advice and I don't know what the best option is for her. I know if the day comes when she needs more care the responsibility will be mine. I work full-time and make ends meet. I have a partner who works full-time and we are willing but to do whatever it takes to care for her. I just need advice. I don't know where to go for advice. I'm reaching out on this blog because it seems to be the most sensible and positive information I've found that is specific to Oregon. I want my siblings to feel good about what financial decisions I make. It is good to know that there are so many agencies which are providing care for these elder people. It really is important to help them become educated to prevent legal problems further down the road, but they have to do it correctly.
